CLARIFICATION TEXT ON PERSONAL DATA PROCESSED WITHIN THE FRAMEWORK OF COVID-19 MEASURES

This Clarification Text has been prepared by the T.R. Büyükçekmece Municipality as the Data Controller (hereinafter referred as the “Organization”) to inform you, about your personal data that we process within the scope of COVID-19 measures pursuant to the Law on Protection of Personal Data No. 6698 (hereinafter referred to as "KVKK") and the relevant legal regulations.

The Nature of the Activity and its Description

The organization, takes measures in accordance with the recommendations of the Ministry of Family, Labor and Social Services and other relevant public institutions and organizations, Occupational Health and Safety No. 6331. Security Law and the requirements of the Public Health Law No. 1593 in order to protect your and the society’s health against the COVID-19 epidemic, which was declared as an epidemic by the World Health Organization, and to prevent the spread of the virus to wider masses.

In this context, the Organization queries the “Hayat Eve Sığar” (“HES”) code from the system declared by you for the in order to eliminate the risk the transmission of the disease during the time spent in the facilities and keeps the results of the HES code.   

The organization limits the above-mentioned data processing activities of providing surveillance for the protection of visitors and those in the Organization buildings against the COVID-19 virus epidemic and fulfilling the occupational health and safety measures at the highest level within this framework.

Sensitive personal data are data about race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, costume and clothing, membership to associations, foundations or unions, health information, sexual life, criminal convictions and security measures, as well as biometric and genetic data.

Sensitive personal data are data, may cause the person to be exposed to discrimination or become a victim if found out by third parties. For this reason, we know that such data require more strict protection and we are extremely sensitive during their processing.

We are processing your sensitive personal data mentioned below in the framework of our COVID-19 practices:

The groups which your data transferred

When you are determined in the risky group by adhering to the above legal reasons, your personal data may be transferred to the authorized domestic institutions and organizations for the purpose of carrying out the activities in accordance with the legislation and informing the authorized institutions and organizations.

Your data is not transferred to abroad.

Your Rights Regarding Your Data

Your rights regarding to the Article 11 of KVKK:

• Requesting information if your personal data is processed,
• To learn the purpose of processing your personal data and whether they are used in accordance with the purpose,
• To know the third parties to whom personal data is transferred, in the country or abroad,
• Requesting correction of personal data in case of incomplete or incorrect processing,
• Requesting the deletion or destruction of personal data within the framework of the conditions stipulated in KVKK,
• Requesting notification of the third parties to whom personal data has been transferred, about the correction of incomplete or incorrect data and the deletion or destruction of personal data upon your request,
• Objecting to the emergence of a result against the person herself/himself by analyzing the processed data exclusively through automated systems,
• Requesting the compensation of the damage in case of loss due to unlawful processing of personal data.

Methods You Should Follow to Exercise Your Rights

For your applications and requests regarding your personal data, through the Relevant Person Application Form,

• By sending to the address “Fatih Mah. Şehremini Sok. No:1 Büyükçekmece / İstanbul” with your original signature and a copy of your identity card,
• By signing with secure electronic signature or mobile signature and sending it to kvkk@bcekmece.bel.tr e-mail address,
• By signing with secure electronic signature or mobile signature and sending it to buyukcekmecebelediyesi@hs01.kep.tr via registered electronic mail (KEP),
• By applying in person with a valid identity document you can send it to the organization.

Within the scope of the legal obligations regarding the procedures and principles of application to the data controller, you, as the relevant person, must submit your name, surname, your signature if your application is written, your identity number if you are a citizen of the Republic of Turkey, your nationality if you are a foreigner, your passport number (or identity card number, if any), your place of residence or your business address  for notification, your e-mail address and fax number for notification, if any, and finally the subject of the request. In addition, you must include documents confirming the identity and information and documents related to the subject of the request in your application.

In order for us to operate the process in the most efficient way for you, you must clearly and understandably state which of your rights you want to exercise in your request, and the details of the process you request.

We would like to emphasize that the subject of the request must be related to the relevant person. If an application is made on behalf of someone else, the person making the request must rely on a specially documented authorization (power of attorney) for the requested process. Unauthorized applications will not be considered.

Evaluation of your Application

We evaluate your applications and get respond you as soon as possible and at the latest within 30 days from the date of receiving your application.
